TERMS OF SERVICE

BY USING AMAFANS YOU AGREE TO THESE TERMS — PLEASE READ THEM CAREFULLY

1. Introduction

These Terms of Service govern your use of AmaFans and your agreement with us. Key things to note:

  • We may modify these Terms at any time. Continued use of AmaFans after changes means you accept the updated Terms.

  • If you purchase a Subscription, it will automatically renew unless you cancel it.

  • If a dispute arises between you and us, you agree to notify us first and attempt mediation before bringing any claim.

2. Who We Are

AmaFans is a South African creator monetisation platform operated by Apex Connection (Pty) Ltd, registered in South Africa. All transactions are processed in South African Rand (ZAR) via PayShap.

3. Definitions

  • AmaFans: our platform, accessible at amafans.co.za

  • Creator: a User who posts Content for Fans to view and pay for

  • Fan: a User who subscribes to or purchases Content from Creators

  • Content: any photos, videos, audio, livestreams, text, or other material uploaded by Users

  • Fan Payment: any payment made by a Fan in connection with a Creator Interaction

  • Creator Earnings: Fan Payments minus AmaFans platform fee (30%)

  • Subscription: a Fan's recurring monthly payment to access a Creator's content

  • Creator Interaction: any subscription, PPV purchase, tip, or direct message payment

  • Upload: to publish, post, share, or otherwise make available any Content on AmaFans

  • User: any person using AmaFans, whether as a Creator, Fan, or both

4. Eligibility

To use AmaFans you must:

  • Be at least 18 years old

  • Be legally capable of entering into a binding contract under South African law

  • Not be prohibited by any applicable law from accessing adult content platforms

  • Not have been convicted of a serious crime involving minors or sexual offences

We may reject any account application without providing reasons.

5. Fan Accounts

To register as a Fan you must:

  • Be at least 18 years old

  • Provide a valid email address and create a secure password

  • Agree to pay for Creator Interactions where required

  • Not share your account credentials with any other person

6. Creator Accounts

To open a Creator account you must additionally:

  • Upload a valid South African ID document or passport and a selfie for verification

  • Add a valid SA bank account for PayShap payouts (FNB, Capitec, Absa, Standard Bank, Nedbank, TymeBank, Investec, or other supported banks)

  • Set your subscription price (maximum R60/month)

  • Agree to our Creator Agreement

  • Submit any additional verification information we request

7. Adult Content

AmaFans hosts adult content. By accessing AmaFans you acknowledge this and confirm you are 18 or older. We are not responsible for any loss or discomfort arising from viewing Content on the platform.

8. Content — Your Responsibilities

  • You are legally responsible for all Content you upload

  • Your Content must comply with all applicable South African laws, including the Films and Publications Act and the Electronic Communications and Transactions Act

  • You must own all rights to your Content or have obtained all necessary licences and consents

  • You warrant that all persons appearing in your Content are at least 18 years old and have given their informed written consent to appear

  • Content must not include any person who has not consented, any minors, or any illegal material

We reserve the right to remove Content that violates our Terms or applicable law without notice.

9. Subscriptions and Payments

  • All prices are in South African Rand (ZAR)

  • Subscriptions renew automatically each month unless cancelled

  • Fan Payments are processed via PayShap and other payments

  • VAT will be added where applicable under South African tax law

  • You may cancel a subscription at any time; access continues until the end of the current billing period

  • Refunds are not provided except where required by the Consumer Protection Act (CPA) of South Africa

10. Creator Payouts

  • AmaFans retains 30% of all Fan Payments as a platform fee

  • Creators receive 70% of all Fan Payments as Creator Earnings

  • Payouts are processed fortnightly via PayShap to your registered SA bank account

  • Minimum payout threshold applies as displayed in your dashboard

  • We do not store sensitive bank account details — payouts are processed via secure third-party providers

  • If a Fan successfully reverses a payment, we may deduct the equivalent Creator Earnings portion

11. Tax Compliance

  • Creators are solely responsible for declaring and paying all taxes on their AmaFans earnings to SARS

  • We provide monthly earnings statements to assist with tax compliance

  • If you are VAT registered, you must notify us and provide your VAT number

  • Non-compliance with SARS obligations may result in account suspension

12. Our Rights

We may at any time:

  • Remove or suspend Content that breaches these Terms or applicable law

  • Suspend or terminate accounts with 30 days notice, or immediately for serious breaches

  • Withhold Creator Earnings pending investigation of suspected fraud or policy violations

  • Use automated tools to review Content for policy compliance

  • Cooperate with South African law enforcement agencies where required

13. Intellectual Property

  • You retain ownership of your Content

  • You grant AmaFans a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your Content solely for the purpose of operating the platform

  • We will never sell your Content to third parties

  • You may request takedown of Content featuring you by contacting support@amafans.co.za

14. Account Termination

  • You may delete your account at any time via Settings

  • Fan accounts will be deleted within a reasonable time; no further subscriptions will be charged

  • Creator accounts remain active until all active subscriptions expire; all unpaid earnings will be paid out before deletion

15. Limitation of Liability

To the maximum extent permitted by South African law, AmaFans is not liable for any indirect, incidental, or consequential loss arising from your use of the platform. Our total liability is limited to the fees you paid to us in the 3 months preceding any claim.

Nothing in these Terms limits our liability for gross negligence or wilful misconduct.

16. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts. We encourage resolution through mediation before litigation.
